The U.S. International Trade Commission (ITC) vote will result in anti-dumping duties being imposed on U.S. imports of R-32 from China

On Feb. 10, 2021, the ITC unanimously determined that a U.S. industry is materially injured by reason of imports of R-32 from China that the U.S. Department of Commerce (Commerce) previously determined are sold in the United States at less than fair value. Arkema brought the case in January 2020 due to the rapid increase in the volume of unfairly traded imports of R-32 brought into the United States from Chinese producers.

 

The decision follows a lengthy investigation by Commerce, which found that imports of R-32 from China were being dumped in the U.S. market at prices below fair value. The affirmative vote by the ITC means that anti-dumping duties ranging from 161.49 percent to 221.06 percent ad valorem will be imposed on all imports of R-32 from China.

 

In the United States, R-32 is used largely as a component in blended refrigerants used in the air conditioning and refrigeration end markets. Long term, Arkema believes R-32 will be vital product to enable the transition to low Global Warming Potential (GWP) products necessary to meet key legislative mandates, such as the American Innovation and Manufacturing (“AIM”) Act, which became law in 2020.
